Can I claim exempt on my W-4 2009?
I am confused on filling out my W-4 for 2009. I am over seas and file Form 2555, "Foreign earned income" for income taxes each year. Then I choose to exempt holdings for 2009?

Made the foreign income exclusion?
I live in Mexico for 2 years and am a bona fide resident of this country. I work for a Mexican company since 2006. I paid taxes to the Mexican government in 2006. I checked the forms 2555, 2555-EZ, and publication 54 on the IRS website and they all imply that I filed the 2555-EZ justifying my request for the foreign earned income exclusion. I have been the equivalent of about $ 4,500 in 2006 and my understanding is that I am able to claim an exclusion for U.S. tax on up to $ 82,400 in 2006. However, I am confused because Publication 54 also stipulates that I must file a return if my gross income was at least 3300 $ If "married filing separately." I'm in the process of filing for green card for my husband, so all my taxes are be in order. Would I have to pay a late filing penalty even if I am not the IRS all back taxes? Thank you in advance for your help.
If you do not have taxes there will be no penalty. If you do not file Form 2555 with your return, file an amended return and include the ASAP 2555. You must file the 2555 with your return for the exclusion. You must file a statement timely claim Feie although there are some exceptions, as explained in the Pub 54. You can still claim the exclusion in a statement filed to a year behind without too much difficulty.
