Durable power of attorneys – also called constant force lawyers – are legal documents that designate a person (known as a lawyer) to act on behalf of a person if that person becomes disabled or incapacitated. So, in other words, a power that gives the document that allows the lawyer to be able to make decisions behalf of the incapacitated or disabled person. It is called "continuous" or "sustainable" because it can be used to the person who gave no longer mentally capable.

To get a valid proxy under the Act Ontario decision Substitutes:

1. The document itself must indicate that it is a continuing power of attorney or express the intention of the authority given may be exercised during the grantor's incapacity to manage property.

2. The document must authorize a person to a lawyer.

3. The grantor (ie the person giving the proxy) must have the ability to give continuing power of attorney (ie through knowledge, awareness, appreciation, etc..)

4. A person with capacity is able to revoke a proxy perpetual.

5. The document must be signed by two witnesses who are (among others) not to counsel the donor or his spouse or partner, person under 18 or a child of the grantor (or somehone are the grantor has demonstrated a settled intention to treat as a child).

The power should not be a formula or model.

A word or two on the requirement that the grantor must have sufficient capacity to give proxy. The settlor must be aged over 18 and mentally capable as the show things like:

* What kind of property he or she has and its approximate value;

* Be aware of obligations to his office;

* Knows that the Attorney must account for his dealings with the property of the person;

* Know what authority is given to the lawyer;

* Se pleased that the Attorney mismanagement could lead to a decline in the value of property;

* Understand the consequences of a Prosecutor abusing their authority.

I need help answering a summons?

Yes, I know I have already posted a few questions with regards to this matter but I am still very confused.
I am being sued in California by a credit card company for unpaid credit debt. I do not deny the debt but there are extenuating circumstances. I am required to “answer” the summons. I spoke to an attorney who advised that there is really no legal form although it must be in “proper legal form.” He also stated that when I mail the copy of my “answer” to the attorney, I must have someone other than myself mail it. He said I cannot fill out the proof of Service. I disagree. I do know that a plaintiff must have someone else serve papers but I am almost certain that the defendant can respond themselves. Please, please.. any help at all? I have navigated the Internet for hours looking for a sample format with which to enter my “answer” to the summons. I find nothing. Thank you so very much.

You don’t have to prove you answered, although it’s a good idea to do so, they have to prove they served you with the summons. As your attorney advised, there is no particular form but you do need to answer in such a way that they know who you are and what you are replying to. It can be as simple as a letter stating your name, information from their form, and the reply that you do not deny you owe them a debt, and perhaps stating what payments you feel you can make. Send it by certified mail and get a return receipt, and keep a copy.

If you do not respond to the summons within the time allowed you will be defaulted from the lawsuit (not allowed to defend). If you owe the debt, maybe you could negotiate a payment plan with the company. If the money is not owed then it is imperative that you respond to the summons. If the debt is owed then the Plaintiff is entitled to a judgment against you for the amount of the debt, interest incurred and likely their attorney’s fees. Upon entry of the judgment, you will be contacted by the creditor to either answer a questionaire regarding your asssets or appear for a deposition regarding your assets. If you truly have no assets, then the creditor can not collect the debt. If you are gainfully employed the creditor may seek to have your wages garnished. Should this happen you may have reason to be exempt from garnishment, check with a local attrorney or see if there is information regarding this on your local Clerk of the Courts website.
