Forms to file after marriage to someone on a visa?

After I marry my guy who is here on a J1 visa what are the forms I have to file to get the ball rolling for him to remain here legally?

You need to file an I-130 ($355) and an I-485 ($1010)concurrently (at the same time). Both forms will go to the Chicago address for filing the I-485. You can also file for an Employment Authorization Document (EAD) which will allow him to work approx within 75-90 days of filing and an Advance Travel Document which will allow him to re-enter the US, if he were to leave, without a visa while waiting on his green card to be issued. The EAD is Form I-765 and the Travel document application is Form I-131. Which immigration form is required to extend intended stay in US?

Are you one of the non-immigrants in US wishing to extend your stay or change to another non-immigrant status? Form I-539 is the form you are looking for! Except for certain A and G non-immigrants the filing fee is $290 apart from the $85 biometric fee.

Who can file Form I-539?

The Form I-539 can be used to extend stay or change status by non-immigrants ambassador or career diplomat using A-1, A-2, attendant or servants using A-3, business visitor using B-1 or tourist with B-2, dependents of a treaty trader or investor with E visa, government designated visitor with G1 through G-4 visa or their attendant or servant with G-5 visa or dependents of a temporary worker with H visa.

A US citizen’s spouse with K-3 or child with K-4 visa can make use of this form for extension of stay during the processing of Form I-130 and up to the Form I-485 adjustment of status application completion.

Also an exchange visitor with J-1 visa, dependents of an intra-company transferee L visa holder, vocational or non-academic student with M-1 visa, dependents of an alien of extraordinary ability or achievement with O visa, dependents of artists, athletes or entertainers with a P visa or dependents of religious worker with R visa should use Form I-539 to extend or change status.TD dependents of TN workers also can use this form to change status or extend stay like how a V type visa holder who is spouse or child of a lawful permanent resident should do.

Form I-539 cannot be used by an alien in US without a visa or with C1 through C4 visa who is in continuous transit to other foreign destination, a crewman with D-1 or D-2 visa or a fiancée with a K-1 or K-2 visa and their dependents.

When to file?

Form I-539 should be filed for extension of stay or change in status before current authorized stay expires, preferably 45 days before your stay expires until and unless there is a valid reason for not filing before the expiry date.

What and where to submit?

For each person included in the Form I-539 application the front and back copy or original Form I-94 non-immigrant arrival or departure record should be submitted with the required fee along with the application. Otherwise Form I-102 application for replacement/initial nonimmigrant arrival/departure document can be submitted along with the application and filing fee.  This applies for visas of B-1, B-2 and M-1 category.

As in the case of A-1, A-2, A-3 and G-1, G-3, G-4 ,G5 visas Form I-566, Interagency Record of Request — A, G or NATO Dependent Employment Authorization or Change/Adjustment to/from A, G or NATO Status must be submitted along Form I-539 and Form I-94 copy. Form I-566 has to be certified by US department of State. For F-1 academic student visa category along with the application Form I-94 copy and Form I-20 certificate of eligibility for Nonimmigrant student must be submitted for change of status. For extension instructions from the school official needs to be followed.

Likewise for E, H, L, O, P and R and TD dependents of TN nonimmigrants visa categories Form I-129, Petition for Alien worker must be submitted along Form I-539 and Form I-94 copy. For J-1 visa category extension or status change original DS-2019, Certificate of eligibility for Exchange visitor status along with the Form I-94 copy and application should be submitted. If you are required to have a passport to be admitted into US, you need to have a valid one at the time you submit the application for the visa extension.

The application must be sent to either the USCIS California or Vermont Service Centers according to the one which accepts filing of your residential area. Instead the application can be filed online which will be routed to the appropriate service center and the receipt will be sent to you indicating where all the support documents must be sent. If Form I-539 is filed at one of the lockbox facilities of USCIS a Form G-1145 E-notification of application/petition acceptance must be clipped to the first page of the application so that you can either get an email or text message notification about the application acceptance. Decision on your application will be notified to you in writing.
